Law and Legal Process

Introduction Laws and regulations are enacted under any profession to govern and regulate various professions. They are applied by courts of law, government bodies and private organizations to ensure that the professions are run in an effective manner. In health professions, laws and regulations are crucial to contain the scope of practice, to offer the grounds for disciplinary procedures, set various procedures, set criminal punishments, and regulate drugs. There are different governmental agencies that supplement and implement the laws and regulations.

The agencies include state and federal bodies in the United States that regulate and govern the health professions. Some of the common federal agencies in the United States include the U.S Food and Drugs Administration and Centers for Disease Control and Prevention (Schwab and Gelfman, 2005).

The U.S Food and Drugs Administration This is a federal agency which is mandated with protection and promotion of public health. This agency carries out its responsibility through regulation of various elements of public health such as food safety, medications, vaccines, tobacco products, and vet products among others. The U.S Food and Drugs Administration oversee the implementation of other laws, particularly Section 361 of the Public Health Service Act and related laws, most of which are not directly associated with food and drugs. This may include sanitation and disease control.

This body is under the United States Department of Health and Human Services. It is led by a Commissioner of Food and Drugs under the appointment of the head of state with the recommendation and agreement of the Senate. The leader of this agency is directly under the Secretary of Health and Human Services. The regulations of this agency vary greatly depending on the product and the power given to it. An example of the regulation under this agency is on all prescription drugs as regards testing, producing, labeling, promoting and marketing, efficiency and security (Schwab and Gelfman, 2005).

The Centers for Disease Control and Prevention The responsibility of the Centers for Disease Control and Prevention is protection of public health and safety. The agency fulfils this responsibility by offering information aimed at enhancing decisions on health. The agency also advances public health through corporations with state health bodies and other organizations dealing with health issues.

The Centers for Disease Control and Prevention points national interest on coming up and application of prevention and control mechanisms on health matters as well as deterrence and education actions developed to promote public health in the country. There are efforts and pleas for this agency to add more communicable diseases under its coverage. This agency is under the Department of Health and Human Services, whose headquarters is in Georgia. One of the regulations of the Centers for Disease Control and Prevention is to ensure information is available to all health departments and organizations aimed at enhancing public health (Schwab and Gelfman, 2005).

Conclusion Public health is a sensitive sphere of life and it requires to be properly regulated. This is the essence of having agencies like the U.S Food and Drugs Administration and Centers for Disease Control and Prevention to ensure that health professions are regulated and governed well. In the United States, these and other state bodies are working very hard to make health professions accountable to the public.
