Laws play an important role in the everyday functions of life, not only at a personally level but in business and society as well. The laws of personal function include but are not limited to, waking up, and preparing meals, taking care of children/family, working, resting and repeating. From a religious stand point personal laws are morals and values, taught and instilled throughout customs and traditions, set forth by God in the Ten Commandments.
The laws of business and society are laws that are/were created to regulate social behavior, supply ethical standards and expectations, peacekeeping, and promote personal freedom so that a business and society are able to run smoothly and proficiently. Without laws and regulations the actions of people would cause disaster.
Therefore, businesses and society would not be able to function smoothly or effectively and would most likely lead to a collapse in humanity. What is Law There are many different types of laws, laws that are set by the government in order to protect its society, laws that are set by a business in order to operate successfully, and laws that are set by nature.
Law is: 1) the principles and regulations established in a community by some authority and applicable to its people, whether in the form of legislation or of custom and policies recognized and enforced by judicial decision, 2) any written or positive rule or collection of rules prescribes under the authority of the state or nation, as by the people in its constitution, 3) the controlling influence of such rules; the condition of society brought about by their observance (maintaining law and order), 4) a system or collection of such rules, 5) the department of knowledge concerned with these rules, jurisprudence (to study law), 6) the body of such rules concerned or derived from a particular source (commercial law), 7) a rule or principle of proper conduct sanctioned by conscience, concepts of natural justice, or the will of a deity (moral law), 8) and a rule or manner of behavior that is instinctive or spontaneous (law of self-preservation) (Dictionary. com, 2012). Laws are created in order for society to function properly and for businesses to control and maintain operations.
Without laws and orders of conduct society and businesses would have no control over the actions of others and would not be able to resolve conflicts or misunderstandings in a peaceful manner. Criminal law is the law through which public commitment of crimes is prosecuted by government agencies and Civil law is the law through which private parties may bring lawsuits against one another for wrongdoings. Substantive laws are the social rights, duties and responsibilities of each individual, and Procedural laws are guidelines through which the government or courts deals with broken/wrong-doing of substantive laws.
Public law defines the outline and guidelines of the relationship between the government and individuals, and Private law defines the guidelines of the relationship between individuals/groups and how they interact with one another. These classifications of law are affective in both business and society by not only defining what is or is not a crime but also by protecting both sides and parties (Voice Yahoo, 2012) . The functions of law are to maintain social control and protect public order by resolving conflicts and disputes in a peaceful and respectful manner. Laws also allow for change to take place in an orderly fashion by laying out guidelines and boundaries that are an acceptable process for implementing and enforcing that change.
In society, constitutional laws are laws that are set to format what the government can or cannot do. Other laws in society are created in order to have control and function over what is acceptable and unacceptable behavior, and to allow the government to have order over those laws that instruct citizens. These laws create a clear set of rules for citizens to follow and and are known as public laws. The laws included under public laws are criminal law, administrative law and constitutional law. Public laws are created to keep society safe and impose penalties for misconduct. In business the laws that create order are private laws such as contracts, real estate and business laws (eHow, 2012).
In conclusion laws are created for different things in different areas of life. In society laws are created to keep people safe, allow the government to maintain order and conduct so that penalties can be implemented when laws are broken. In business laws are created to hold a person responsible for his or her actions or another company responsible for their part of a contract. Laws create a smooth production in business and create order in society. Laws are also something that is instilled or thought to people during their childhood and more commonly are referred to as morals and values. Good morals and values create for and peaceful and harmonious way of life not only in society but in business as well.
