I have the disposition to announce in No. 78-599, the Secretary of the Navy against Huff.

And for reasons stated in a per curiam opinion filed with the clerk today, the judgment of the United States Court of Appeals for the District of Columbia Circuit is reversed.

Mr. Justice Brennan filed a dissenting opinion.

Mr. Justice Stewart and Mr. Justice Stevens joined in dissenting for reasons stated in their opinion in Brown against Glines, the case just previously announced.

Here too, Mr. Justice Marshall took no part in either the consideration or the decision of the case.
