Anthony M. Kennedy:
In particular, she argues the University could have uncapped the Ten Percent Plan and admitted more if not all students through that system.
That approach, however, would sacrifice all other aspects of diversity in pursuit of enrolling a higher number of minority students.
To compel university to admit students based on class rank alone is in deep tension with the goal of educational diversity as this Court's cases have defined it.
For these and other reasons set forth in the opinion, the judgment of the Court of Appeals for the Fifth Circuit is affirmed.
