Facts of the Case

Respondent, a Mexican-American, was convicted of burglary of a private residence at night with intent to rape. On his petition for habeas corpus, the circuit court of appeals held that he was denied due process and equal protection under thebased on the under-representation of Mexican-Americans on county grand juries. The State sought review by certiorari and the court affirmed the prior judgment.
