I have also to announce the judgment and opinion of the Court in 73-1347, Board of School Commissioners of the City of Indianapolis against Jacobs.

And for reasons stated in an opinion for the Court filed this morning, the judgment of the Court of Appeals is vacated and the case is remanded to that Court with instructions to order the District Court to vacate its judgment and dismiss the complaint.

Mr. Justice Douglas filed a dissenting opinion.
